0	Judge Who Smiled Her Way Through Arrest Gets Maximum Sentence, Loses it Right, the reason drunk driving is illegal is because people get in accidents at a much higher rate than when they drive sober. Police arrest people who are drunk driving because they are a danger, however you cannot add charges to them because they are more likely to do something. You can't charge her with vehicular manslaughter, for example, just because she was more likely to commit it while drunk driving because she did not do that.
