I'm in the exact same situation. Primary parent for our 3 year old. We also have a child under 1. So far I'm being treated as a second class citizen but I'll have my day in court later this year. Until then I'll continue to be there for my kids during the short visits I have with them.

In Canada it's typically 50/50. But in the US, do fathers actually not get 50/50, unless there are safety circumstances?

In Canada there's a financial equalization process where it's cut and dry, who takes what in terms of assets / investments. Can you really negotiate that? I'm not yet at your stage, still early days with a toxic ex who accused me of all sorts of lies and I've got two kids under 3. Sorting out the custody thru urgent court. I hope the mediation goes in your favour!

You can keep the mortgage and remove the spouses name if you qualify to maintain the entire mortgage. My bank just confirmed this.

This! I'm going thru a separation with a toxic ex and I feel like these bullets are her. She actually accused me of domestic violence (no proof because it didn't happen). I can't wait for this all to be over and behind me.

How did the situation evolve afterwards? Was she still toxic and trying to bait you?

She wanted to file a tro. She couldn't because there was no proof, because nothing happened. She's not allowing any contact except for a few hours, 2 days a week. She ghosted me and everyone who tried to contact her.

Get out and live! I'm turning 40 next Friday and I'm going thru the worst separation ever. Two kids 3 and 1. The children's mom has an undiagnosed mental illness. She abducted them and I'm going thru the process of an urgent motion to get 50/50, will probably cost me $15k - $20k tot but she will have to pay some of my fees because she's being uncooperative 😆. Your situation is a good one to be in. Divorce ASAP and LIVE YOUR LIFE. All the best and much love brother.

This is in Canada. I see them only a few hours twice per week. The kids have regressed since they have been taken away from the matrimonial home. They have been taken 40kms away. The court may take a few more weeks to get an urgent date. Im in my rights to keep the kids next time they visit but I haven't done anything wrong to date and don't want to tarnish my optics as my ex has been doing everything wrong. Dads, how have you dealt with similar situations?

You can kill a man, but you can't kill an idea.
