You are entitled to 50% of the 401K either way. Whatever you do, don’t say that you will take money and give up parenting time. The courts are not going to like that. Get a lawyer and let them negotiate.

To answer your question - it is normal behavior, or is at least somewhat common. I had the same thing happen to me. We separated, she was with at least one other guy. Then on the day the papers needed to be signed she called me over and over. Texted my friends when she could t get ahold of me. Sign the papers man. It gets so much better but you’ll need some time.

That's what I have. The custody schedule is in the official paperwork. We can go ahead and switch up days here and there if we both agree - and we do that at times. But I can fall back on the divorce decree if needed. It sounds like you are doing the right things. Hiring a lawyer, going for 50/50. Hang in there man. Listen to your lawyer, not her. Talk to an attorney first. Sounds like you already know this. But I would talk to one and have them retained. I’m also in MN. I was able to move out and get an apartment. I did speak to an attorney and retain them prior to signing a lease. I’d also have a parenting time schedule set up - 50/50 if you do move out so you can show that you have been parenting 50/50 when it gets to mediation (or further). My ex got tablets through t-mobile. It is nice because I can text my kids (also have an 8yr old). You can FaceTime as well. That being said, it’s ok to limit tablet time. Ex pushed boundaries and will FaceTime at 9:30 pm.

I’m dealing with this. Look at the contract you signed with the clinic. It may outline what happens in divorce. Also there have been cases like this such as the one in Arizona’s Supreme Court. The woman could not use her ex’s embryos. But whatever the outcome, fight it if needed. Do 50/50 ownership and pay the storage fees if needed. It is half yours.

Damn. I’m in the same position with the embryos. You may have signed something that tells you what happens to them if you get divorced. But either way hire a lawyer. I plan on fighting that battle later if it ever comes down to it.

Hey man. 44m in MN here as well :) I've filled out that calculator quite a few times, we are still going through things. You at 70K - $5833 a month Her at 40K - $3333 a month I'm seeing your Net Child Support Obligation at $162 / month for 1 kid (based on 50/50 parenting time) You mention health care and child support. I think you might pay a bit more for that. I'm still trying to figure this out on my end - if that gets split based on income. Definitely talk to a couple of lawyers in your area.…
