“Game theory” definition is any risk/reward comparison to look at potential outcomes to decision making. That implies you think something is wrong and can make the other person clam up more. Better tact is just finding a way to make them at ease, and being comfortable yourself is a good way to accomplish that.

you might be able to get a mistrial but an appeal would generally have to do with a wrongful conviction. and in this mans case (19yo is a man, albeit likely immature), he was "correctly" "convicted" based on the evidence presented. now IANAL but i dont know what can be done about resentencing.

yea, i see how it reads like that - i was more at getting across the point that the charismatic individuals that seem to draw people to them are the ones that are confident and genuine and seem totally comfortable in their skin (i.e. RDJ)
