I'm arguing that for the crime that's there, this is an appropriate sentence. This was an expected outcome when they passed the law. In my view, the law is not-gender aware. Alright, based on the facts prove that she doesn't have a mental illness or some gross misunderstanding of how the system works. You think you could prosecute based on the information, go for it. Remember, if there is any reasonable doubt, you lose (so if they argue that she's just an idiot and doesn't get it, you lose on the specific intent). Murder, manslaughter, negligent homicide are different charges not different sentences. By analogy, you're arguing that we should convict for a homicide and then sort out how bad it was in sentencing. They also don't take the damages into consideration (that much it's more the egregiousness of the crime which is different). Intent is an element of a crime. How are you going to distinguish between specific intent and reckless indifference in these cases? Specific intent is very difficult to prove, even in cases like this because for all we know the person was drunk and angry and didn't think about the consequences, just that he'd "eave her alone" or something. The charges are appropriate for the crime. So, yes, I think it's fair to let her off with community service. Community service is a very useful and humbling tool. It exposes the person to strangers as a known criminal, they often ask what the conviction was. She also now has a crime of dishonesty against her, which can be used against her in court or disqualify her from a wide variety of jobs. Improper turn signal could lead to a capital sentence if that were the case.
