The man would probably have a few years in prison judging from similar cases with both female and male teachers involved. Female high school teacher faces probation and no sex offender registration after having sex over 50 times w There is a distinction under California law for minors under age 14. http://codes.lp.findlaw.com/cacode/PEN/3/1/9/5/s288 The reason they have a difference with age is because an adult who has sex with an 8 year old is probably way more fucked up than an adult who has sex with a 17 year old. Basically under 14 is considered a child while 14-17 is a minor. I don't know all the details but there is a difference in age and 13 and 15 are on different sides. The law in California states it's child molestation when under the age of 14. 13 is considered a child while 15 is statutory. You may disagree with that, but that's the law.
