She is employed but there's a huge difference in our incomes. She has made statements to me that she is expecting to get half of my income. I'm not afraid if court but I'd like to settle out of it. If she continues to be unreasonable then I will get a better outcome in court

Yes the mediator said that her side is way off base. I'm going to have to try and discuss things before the mediation date. She is taking the lead of her attorney. He is younger and has less than a decade of experience. I agree a huge waste

Thanks for the information. As it sits right now she is getting the equity in the house, half of the retirement and she is asking for support on top of it. There is a big difference in income between us. We have agreed on 50/50 custody of my one minor child. I'm working on offering her a lump sum bit I don't think her attorney will advise her to accept it. I'm almost at a point where going to trial makes more sense. I have nothing else to lose.

MN does not have a formula. By statute, the support can be permanent but I plan to offer her a fair lump sum at reduced level. If she does not agree and is not reasonable then we will go to court and spend it all on the legal fees.

True and I think her attorney in particular has no interest in settling. He is making promises to her that are not realistic. It's a conflict of interest with divorce attorneys. The see how much money you have and then can determine if you can afford to go to trial or not

We are very far apart on her request for support. She asked for way too much. If I adopt her current position I'll go bankrupt.

Spousal support is the main issue. She is asking for way too much and my attorney and CPA are saying their initial request is not on the planet and not worth a response

The main sticking point is spousal support and we are very far apart.

Are you saying figuring out how the marital assets are and offer her a cash offer of less than 50% of that? The most cash I really have is on the house but it would be hard to come up with half of the assets in cash. I could do a combination of investments and cash. What do you mean by PRE? We are going to do a vocational assessment on her before the next mediation session. I agree her income should be imputed as to what she should be making as a union teacher with her years of experience. Thank…

Pegleg_legal Good point on the leverage, I feel I dont have any. She would have to be smart enough to understand the concept of the time value of money, which she doesn't have a clue. The guardianship answer right now is both of us, even after the divorce. I will forever be tied to her in that way

I thought about setting the money aside too. That could work in my case. This is the second marriage for her and I can't see how anyone would marry her. She can't get out of bed to do anything

You can kill a man, but you can't kill an idea.
