I let go of 50-50 to avoid a trial with my ex. Kid was 8 yo. We ended up where she got 4 nights per week and I got 3. It burns me as a matter of principle but courts are unpredictable, it saved me lots of money, and it probably helped keep things between me and the ex from going to complete and utter shit. Avvo is a scam. It’s just advertising. Don’t believe it. Also most awards and organizations are either pay to play or popularity contests. They don’t indicate quality. I agree you should try to get referrals from friends and family. Get someone who specializes in family law. Do not hire someone who does a variety of other types of law. I believe in Washington you need to look into the “Committed Intimate Relationship” statute. It covers these types of break ups. I don’t remember but I believe your assets and liabilities get treated the same as a traditional divorce.

I tried really hard to co-parent post divorce. There were some successes. But I recently gave up. It’s all the same arguments and crap as from when we were married. Now it’s mostly parallel parenting. We keep things positive with the kid and when we have to be together in public. To echo what others have said, this will likely save you lots of money. If the two attorneys know and trust each other you are less likely to be stuck in disputes that cost attorney fees but don’t ultimately move the needle toward trial or settlement (eg discovery disputes). A professional relationship doesn’t mean the parties aren’t adversaries.

No specific event. Just multiple years of feeling we were the wrong fit. Counseling didn’t work. I was scared to leave bc of custody issues with small kids. It was worth it. I am so much happier. And I got shared custody. There is life out there

Just do it. Any marginal potential financial benefit in waiting until later to file (which is uncertain) is not worth wasting more of your life with the wrong person.

The only thing I see here of real value is getting to a deal on the house. The legal fee stuff is a non-starter. And the requirement to mediate in the future... it’s fine but really not a big deal one way or the other. I wouldn’t want it. Can’t really give you good advice without knowing your situation and what issues are hotly in dispute. But in general your list has a lot of unrealistic expectations in it. Mediation involves a lot of sitting around. Be patient and let the process play out.

My ex is the same. Drove her crazy that she didn’t get to dictate terms, timing, etc. You will be so happy when it is done. It is worth it. Mine was protracted but we kept it mostly very civil. I highly recommend getting a divorce coach for yourself (in addition to a good attorney). It was the best thing I did. Helped me keep things child-focused and was cheaper than whining to my lawyer.

My ex made the same argument. It is not supported by data (except for very young kids). Fight for more time. I did and got it. She ultimately caved on the eve of trial. It’s been over a year now post-divorce and our daughter is doing great. She’s 10 yo, btw. I bought a house 2 blocks away from the ex to make it easier for the kid and our families. You can do this!

If you need emotional support See a divorce coach or a therapist specializing in divorce. By yourself. Not with you ex. The longer this goes on the worse it will be for you. Otherwise hire a lawyer and just file. Get it over with. You’ve been married such a short time it shouldn’t have a major influence on your financial affairs. The longer you are together the worse it will get.

Yes I used one. It was the best money I spent. He helped me prepare for the divorce, deal with my spouse and keep my daughters interest first. I also saved money by spending time talking to him and keeping my lawyer time focused on the case and not on emotional issues.

Don’t be penny wise and pound foolish. Spend the money on an attorney. Don’t listen to all these other comments. Prenups work. 99 percent of divorce cases settle. the prenup gives you leverage in settlement.

I’m not sure I understand what rights to the phone you are taking about? What is it you intend to do? Take her phone? Copy the text messages? Her friends will think you are asshole. That is out of your control. Let that go. Don’t text them to defend yourself. You need to start doing divorce preparation. That means CONSULT WITH LAWYERS about how to proactively protect yourself. This is the only answer. A couple of consults will be a few hundred dollars. It will be worth it.

This is not your turn to win the case and tell your story. That will happen at trial on direct exam. Listen to the question. Answer the question. Nothing more. Don’t volunteer extra information that is not asked. If they ask what you had for breakfast, the answer is “toast” or “cereal”. Do not say where you ate, who you ate with, how much it costs, if you enjoyed it, etc. If the attorney asks the follow up question, fine. If they don’t ask, fine. Just answer what is asked and not what you think …
