I'm not sure if it's in the entire US, but where I'm at has what is called 'presumed consent.' If you're unconscious or unable to do so, it is presumed that you give consent when a person or people are trying to save your life. Tha pt way you can't sue the person for breaking your ribs, for example, when they perform CPR on you, or claim sexual assault if they have to give mouth-to-mouth.

I'm not sure, really. We know that men do actually make more, but that's because of things like working more overtime, jobs that pay more for various reasons, and other things. When the person is that drunk, it's rather obvious. So you're totally okay with sleeping with a person who you know is drunk, despite people not being able to make decisions as they normally would? Sorry, but if they're under the influence, then by legal definition it can count as rape. While I agree with the rest of the article, and while I don't agree with this statistician including every person who imbibed as being raped, you can't say that it isn't rape if a person gets a person intoxicated…

The phrasing. “have you had sexual intercourse when you didn’t want to because a man gave you alcohol or drugs?” is where I'm stuck. I don't sleep with people who are intoxicated, because they do not have their full judgement. If they know you are intoxicated, then it can be construed as rape. Most especially when they did not want to have sex before that.

The piece that sticks in my craw against this argument is that the writer does count rape as sex under the influence when, prior to this, sex was not desired. I'd count that as rape.

The offshoot of this though is, at least I imagine, that it is guys mostly doing the asking out. At work a while back, we brought up the idea of women asking men out. The women were mortified by the idea, with the basis being "what if he said no? I don't think I could deal with that. I'd be so embarrassed!"

This is the point I try to make to some of my very vocal female friends. It's not bashing women, it's just true that women are not as strong as men. The top 20% of women are only about as strong, fast, etc, as the bottom 20% of male infantry. In a situation where the group moves as fast as the slowest member, that can have deadly consequences. This is even more true when there are different standards.
