It just has to go through the courts. And divorced men keep custody of their children, it’s super rare for them to lose custody. Also even if a man doesn’t get custody of a baby after suing, he is basically guaranteed regular visitation. If they get divorced they still share custody. If the parents are not married the mother automatically gets sole custody of the baby when it is born, the parents can then choose to change it to shared custody. If one doesn’t want to share custody but the other does, they can sue.
