Not that you're wrong but you understand how the DAs would then be VERY unlikely to take any but the most obvious slam dunk cases to trial, right? In theory that's what we'd all want but that only means that only the stupidest or sloppiest criminals get charged and go to trial. I get where you're coming from but trying to prove malice versus mere incompetence is a pretty hazy line and a fair number of prosecutors would simply let marginal cases slide.
