It’s not the date of divorce it’s the date the community property is severed. Those could be the same but probably separate. With kids in La you have to wait a year to get a divorce finalized, but the community property could’ve been severed way before that. Find that date. House is a loss. Yes should would be entitled to what her half grew to in the 401k (under normal circumstances). Did he move the house in his name and get her off of it at that point? Eg is he the sole owner? The date the community was severed is where everything considered community prop stops. So any more money he saved, items procured etc. She would be entitled to her half of the growth of the 401k under normal circumstances though, which would be considerable. If he had 100k in 2009 (she’s entitled 50k for easy math) that $50k has grown aggressively for 16 years now and is worth >$250k I would bet. But…
