If your question is whether or not you can negotiate a lower buyout for her if she accepts your logic re: sales costs, then yes, you guys can technically agree on anything you want. If your question is whether or not a judge would rule that she has to bake in those sales costs then the answer is definitely not. At a minimum though, a judge would protect any of your pre-marital contributions in principal form in CA.

I think in CA what happens is you need to do a tracing whereby if you made principal payments on the home pre-marriage (down payment and principal paydowns over time) and then principal paydowns over time on the home post-marriage, then each of those flat amounts will represent X% of the total principal paid into the house. I think you can take your pre-marital percent contribution off the top and then split the remainder of the equity from after you got married. That being said, your X can prob…

Yea, overall this is the issue men face. Pay up to engage in endlessly dragged out custody battles or lose access to your kid. Women do not have to meet the same standard in court to get 50% custody. CA is probably one of the most egalitarian states and it is still like this.

My friend just spent 180K on his divorce and if he'd wanted to take it all the way to trial it would have been north of 300K. He would fall under the statistic of 'men who don't fight for their kids' because he didn't make it to full trial. How much money do women expect people to spend fighting for custody? It's insane.

I just watched a friend get a divorce in CA. He was a high earner and so was his wife. She immediately asked for 100% custody and him 0% custody. She shoved him and grab shit out of his car during exchanges, she screamed at the mediator, he lost his job trying to pick the kid up from school on the early bus because she wouldn't sign to release on the later bus, and then tried to impute his income to 500K+ while he was making 0 dollars. His time was consumed fighting fighting fighting. He did end…

I think these women posters should have to sit through a day of family court hearings. I did, and watched a friend, and it was absolutely horrible. This was in CA by the way a "50-50" state. In her post she says working all the time is no excuse to see a kid. Does she know about imputed income? Idk, I think the people posting on here are mostly children.

Honestly this is more relatable than your original post. You might as well be honest with yourself that you wanted to go out on NYE and she is trying to send the kid back early. Why not just tell her no? Technically if he's with her and you have to come and pick him up (or meet her for a drop off), she's kind of at your mercy. In your shoes, I would never rearrange any travel or plans on her behalf because she obviously doesn't have the same respect for you and your time. If you don't have trave…

No offense but I have a different POV on your post than many of the comments here. Your writing sounds more like an angry ex wife than an ex husband. Basically, you seem to have a pretty good custody arrangement that's working for everyone, where your kid gets to see both parents a reasonable amount of time (if not exactly equal), and people don't (seem) to be pissed off about the financials. However, you've assigned your child's entire winter break to your ex wife (which I assume based on schoo…

If a lawyer won't help you with this, who will? An accountant? A lawyer who isn't a divorce lawyer?

Why did you even let her stalk your girlfriend and treat her like shit in the first place? You don't have to "let" someone do anything - you could have not told her about your GF in the first place, or shared your GF's name, or cared about her opinion of whether or not your GF should attend an event... If someone is hostile, don't give them information about your personal life. Doesn't matter if you have kids or not.

Let's break this down: I'm assuming that your CS is based on the state calculator, so neither of you are getting a "deal" on that piece of this equation. Did you impute her income to minimum wage when you ran that calculation? If not, you need to. If you did though, and the CS numbers are correct, then essentially your negotiation was you taking on 10K in tax debt and 120K in SBA loan debt in exchange for only paying her $1300.00 a month in alimony over 3 years (instead of 9 years, which seems t…

Then does that mean in another two years you can go back and argue for a modification in your opinion? Or the general consensus that once you're pegged in a state like California, you're pegged forever?
