The note she posted and the video surveillance of her having done so... that would be evidence. It's the same as if someone decides to fire a gun into the air without any consideration to the person miles away who is struck by a falling bullet -- indeed, there have been many such cases. If anyone does this and then tries to claim that they weren't aiming at anyone in particular, how do you suppose that would work out in a courtroom?
