Simple. The school is not responsible for defining the elements of rape. If the rule of law in PA is rape is a man penetrating a woman without consent, then the school is merely playing by the rules established by the legislature. This is all speculative though, I don't know the current statutory scheme. Im merely pointing out that this title has a very real chance at wayyyyy over exaggerating the situation without more.

At old common law, men and boys weren't a part of the statutory scope. Rape was defined as only possible by a man to a woman (not his wife). PA has an old common law tradition, so maybe that's why. Edit: I just looked it up, PA's statute is broad enough to encompass the Sandusky cases. Which, should have been obvious in the first place, because it went through the court system....publicly. Also have a narrow statute for specifically "Rape of a Child" Title 18 Subchapter B Sec 3121 (c).
