It depends on the context. If they testified under oath in court that they were raped by that person then that is a felony charge - perjury. If they told the police, then filing a false report to the police (this is what the woman in the OP's link was charged with.) In both instances they can also be sued for defamation. It depends on the situation, like whether they reported it to the police/testified under oath or not. If it is just them telling all their mutual friends that they're a rapist, they can sue for defamation. They do have to live with the consequences, but the law isn't meant to protect people from every shitty thing that happens to a person. It's not about who's a better person. Right now our justice system is focused on justice through punishment. Such a system says that we need to punish those who committed a crime proportionally. You factor in intent, context (Passion vs premeditated) and the actual outcome. The actual outcome is in part what determines the charge because it means you're paying your "debt" to society by saving those extra number of years.

FYI I think our ay of handling this is flawed, but the solution is not what that guy suggested. A big problem is that if your name is slandered in a law suit but you aren't a party in it, you have no way of defending yourself. Yes, if the rape charge doesn't go to court then they wont' get charged with perjury. They are still able to sue for defamation though. I mean I know it sucks that shitty people can't get what's coming to them, but the rape accusations that don't happen under oath is the same thing with shit like slander. It's civil at best, and there's no reason we need to up it to a felony. What you are suggesting would be incredibly hard, if not impossible, to enforce.

There are felony charges for false accusations. Like this girl getting one. The problem is, people seem to think it's really easy to determine when a false accusation happens. Actually the legal system already has changed from what that person is advocating. We used to conduct law based on an eye for an eye centuries ago, but then we realized that was a terrible basis for a legal code and went with something a lot more nuanced. It isn't going to be changed, because how we determine punishments is not based solely on the criteria you are talking about. A person who commits murder deserves and will get a heavier sentence than someone who tries to frame another person for murder. Just because they TRIED to send them to jail for an X amount of years does not warrant a sentence that long. Our legal system is not based on an eye for an eye, it's a lot more nuanced than that and we take a lot of things into account.
