The fact that the two states are closely intertwined is why Turner could have honestly not known the situation as it unfolded. Alcohol is a drug, and I highly doubt that Turner was even in a state of mind to determine anyone's consciousness. The the way the victim and Turner paint the picture, it's very likely that Turner was made to feel that she intended to hook up with him. She passed out mid fingering and I doubt he (Turner) was coherent enough to notice. 6	Brock Turner Clearly, both parties had been drinking, and Turner was less drunk than the victim simply because he remembers what happens. According to the victim's statement, she only remembers talking to a few guys before "blacking out" due to alcohol consumption. According to Turner's statement, he claims the victim led him away from the house while they were hooking up.
