Lawyer up. NAL and not closely familiar with CA laws. Absolutely do not believe her lawyers advice that she’s relaying second hand. Full disclosure - I am a wife contemplating divorce This is abuse. It is domestic violence. It needs to be recorded and you should not be intimidated into dropping charges that by law the police were forced to file. If you gave “gifts” in terms of cash payments that you can prove (checks, cash apps, STBXW agrees you made payments, even receipts that prove the items only benefitted the minor children, etc.) those can be credited to what you owe. This. Get a lawyer. If you can prove there was deception and fraud entering the marriage, there may be a chance for annulment based on fraud - which then you will each keep your own assets. Recommendation - if the spouse is irresponsible with paying bills, that won’t get any better after the divorce. “Splitting” the bills in 1/2 means nothing to creditors: you’re still responsible.
