Here's the problem with those laws - they're impossible to enforce justly. If a manager hires a man over a woman, there could be a thousand different reasons, most perfectly fine. Exactly - I often give up my seat, but it's because I'm able-bodied and healthy, not because I'm male. I wasn't trying to stereotype Democrats. That was just one example. I could also have used "Republicans who say they are pro-life because they want to outlaw abortions, but then never actually do anything to help adoption centers get funding," etc. It was just a general bash against hypocrisy, and since I'm a political guy, that was the first example that popped into my head. :)

A more relevant question - if you could actually pay a woman 77% of what you'd pay a man and receive the same quality and quantity of work, to the point where you wouldn't know if it was a man or woman doing the work without checking, why wouldn't every company in America with even a halfway competent management staff fire every man and hire exclusively women? In the event of an unwanted pregnancy, if the woman doesn't want the child, she pays the price of an abortion. If a man doesn't want the child, the fair thing is to say that's all he has to pay. He gives that much to her, and then whatever she chooses to do is on her, guy's out. THAT'S fair.

But if the difference ends up being only 2-4%, doesn't that demonstrate that the wage gap was much, much smaller than advertised? Also, I wasn't using my statement as proof that the wage gap is negligible/nonexistent. The actual numbers do that just fine. My passage was meant simply to demonstrate how foolish it is to believe in the wage gap to begin with, if its size was truly what some people claim.

If the wage gap isn't a myth, if women truly did get paid less for exactly equal quality and quantity of work, then any company that doesn't immediately fire all its male employees and replace them with female ones is throwing money away.
