| 1 | My partner has been smoking weed while knowingly pregnant. Is there anything I can do legally to get custody?Depends on the state you reside in. Check your state laws, county social services/CPS. Not sure with the weed given the changing views/laws each state, but cocaine or any other illicit substance may be more concerning to where a case can be open. To have the child remove would require more usually, but keep everything document. Would suggest making police reports especially if violent behavior is involved, some states may favor a non-violent parent for sake of child safety.
