Yes a restraining order would be the proper action. A TRO covers both you and any family members listed. California is very even keeled when it comes to genders in a divorce. My wife is hilarious. She blames me for filing. Months earlier I came home to an empty apartment and had to get lawyers just to see my son. When I lawyered up she filed a TRO to interrupt the child custody hearing. But yes apparently it was 100% my choice to divorce her according to her.

Claiming mental health problems is probably the most common form of manipulation and abuse. Taking shots back is more helpful for the kids. Accountability is an important lesson for kids to learn, forgiving abuse is not. Therapy can only help the willing and nobody else. This is why marriage counseling never works, it requires two willing people. Yes he can do anything for his kids because they aren't abusers.

Have you had the first hearing? If the court hasn't said you can't leave you should be fine. Just make sure you do return in 4 days and make sure your wife knows ahead of time. I imagine at this point both of you still have full custody so you can take them anywhere you want without thier other parents permission or approval.

First get a lawyer. Everyone on this sub regrets not getting one soon enough. Next file a restraining order against her for slapping and throwing things. As part of the restraining order you can get temporary sole use of the house. If she wants alimony you need to lawyer up. The no fault, do it yourself divorces are for people that want to split everything and go thier own ways. It doesn't work for people who still want to be tied with child support and alimony. Also if she cheated on you she can't be trusted. Courts and lawyers were made to counteract dishonest people, use them.

I can only communicate by phone or text so recording should be easy. I should start journaling know that I have the time.
