Tried that, the DA wouldn't touch it, the family court judges wouldn't touch it, even Child Protection Services wouldn't touch it. In fact CPS told me that "If the mother doesn't want her kids to see you, there is likely a good reason." This really was a common reaction, people assumed that since I wasn't allowed to see my kids by my ex, that I somehow was at fault, or was abusive, or worse... :/

I agree... we currently are waiting to get back into court to stop the child support (yes, she is still taking the $1600 a month even though my daughter is with me...). She appearently is refusing to sign the paperwork in order to force a court hearing, which will take a few months, giving her a few more months of support. it is two different things. I could marry a woman with 3 kids, but I am not legally their parent or guardian unless I adopt them. If I do not adopt them, and we divorced, she would take her children, I would have no parental rights, and pay no child support. If I adopted them, I get parental rights, visitations, and would pay child support.

There is Alimony, it is just called "spousal support", and cannot be open ended, meaning it has a fixed end date when the divorce is finalized, and cannot be changed Source: I had to pay spousal support for 2 years in Texas (3.5 years if you count the 18 months I paid while trying to get the divorce finalized).

I don't agree with your statement at all. The AZ system is much than most, In fact it would seam whoever wrote the AZ law agrees with you. In AZ, If I make 45k a year, and my ex-wife makes 35k a year, and we have 1 10 year old child, I would only pay support on the difference ($60.38 per month) as she does not need that much money to support the child. Verse the classic system I would just pay her 20% of my income (@$600 a month w/ 45k a year income). Not sure how anyone get 46k a month in child…

Hey... I have no beef with it. It take the income of parents into account, and calculates a reasonable support payment. If one parent makes more or less money, support is adjusted... If both parents make the same, there is no support, if the paying parent looses their job, the support is reversed and the normally paying parent will receive child support. Pretty close to how it should be IMHO. Again... in TX I have to pay $1500 a month for one kid, in AZ I would pay $392.

Correct... in fact if they had shared custody and followed a standard visitation arrangement, mom would pay him support while he is looking for work. This is a pretty fair way to calculate child support in all reality, if his ex-wife gets a new job or a raise and makes more money his child support will decrease as she will not need as much money to meet the needs of the child. That is not why the adopted clause is in there. It is designed so that if OP (or his ex) gets re-married into a family with children, and OP or his EX adopts those kids as their own, they will get the income deduction.

In a nutshell: AZ calculates support based on the difference in incomes, meaning they actually look at mom's income to determine support. BOTH parents get "deductions" from their income for other children they have to support. In this case OP's ex had a baby, she got a deduction, thus the difference in income was greater, and OP's support went up. Courts never enforce anything when it comes to mothers. How many mothers completely ignore court orders and custody plans and just do whatever the fuck they want. I have drug my ex-wife before a judge 6 times, and not once has any of them enforced an order. In fact my ex-wife has not followed a single order, and never been held accountable.

More than that, Nevada (which is surprising low), North Carolina, Delaware, etc. all have caps in one form or another. This issue is like Texas, that limit is pretty high, much higher than the $800 suggested, and that limit is set to child support only and does not encompass alimony or spousal support. Nevada has the lowest child support amounts of any state I have looked into yet; capping out at just over $1k a month for someone making 14k+ a month gross income.

First, immediately contact the county clerk in the court that issued his child support order, there is almost always a way to reduce his child support in cases of unemployment. Nothing you can do my friend. You are still married, she still owns everything in the house, it is her stuff and she has every right to be there, even if she moved out and you are separated.... BUT you can not enter HER apartment as it is only hers.
