He is accurate. Inheritance is NOT equitably divisible property in divorce in the state of Georgia. IF they want to argue how you mistakenly transferred some of the interest from the inheritance to the marital account with both your names on it and it (the interest) was used in the benefit of the marriage, then that would be the ONLY possible loophole that the lawyer could possibly be going after. If you have 50/50 and your lawyer allowed for CS and alimony to happen WITH evidence that she made more than you for 20 of the 23 years, that’s a HUGE problem and you should look at a new lawyer. Subpoena her tax records if you can’t provide them for at least the last 7 years and ALL financials as far as you can go back. Too bad, TBH. If the shoe was on the other foot, she wouldn’t care if you asked. Women in divorce don’t. They remarry and the courts won’t take into consideration that there is a two income household and the father shouldn’t have to pay as much in CS or anything. Just let it go. There isn’t anything you can do since the divorce is already finalized. This all should have been looked at PRIOR to even going to mediation or the judge. ALL of this should have been asked for in discovery. If anything, you should have been able to subpoena her and your bank accounts in their entirety to go through each and every transaction. Courts won’t help. Mom is wrong. Child will learn to just distance themselves from being near that person and potentially mom as well. Mom should stand up for your child to the new BF but obviously is putting new BF as a priority over your child.

So you can do as you like. You can talk with her and go to like H&R Block, they can run you and her separately and then jointly for a rough estimate on what can happen, even adding in kids and some deductions (like house). I did this with my exwife last year for 2024. I owed like $3k, she owed like $12k, together it was like $13k. We ended up doing it married but separately and each claiming one child, I gave her the ability to claim our youngest which also included daycare.

Yep. I would video and inventory everything and immediately go to the divorce lawyer and possibly a criminal lawyer to see what can be done because it should be theft, sale of stolen property, destruction of property, contempt of court and probably some other things as well.

Look, YOU need to go into mediation with a plan. Your lawyer should be discussing that with you and you should have sat down with them to sort all this out. List what you want, what you’re willing to give to her, what you want 50/50, etc. do NOT go in leaving it up to her OR the mediator, you will get hosed.

Yep, you are responsible for half the debt accumulated during marriage. The ONLY debt that you are NOT responsible for are student loans. Student loans are NOT equally divisible in divorce, they are the sole debt of the individual who took them out and whose name they are in.

I fired my first attorney as well due to lack of communication. Everything is told them or what I said I wanted, even when I presented evidence AND previous case law WITHIN the state and surrounding states, they would just either blow me off or say “no, not going to happen.”

Well, most of my friends, aside from guys who knew me for like 20+ years don’t really talk to me at all. Financially, I will rebuild and like you, everything will be going into a trust in my kids names so they get everything. It is what it is and I just don’t care anymore. It doesn’t make sense to anyone that pays it! If you get a raise, promotion, second job they have the ability to take you back to court for an increase because “they deserve it”. Dude, if you made double what she did, you’re hosed. My friend from PA had two kids, twins, got divorced. They were in a town outside Pittsburgh. He ended up paying $3,600/month for the two kids and she got primary custody. He got every other weekend. If he got another job to help offset the $1,400 he had left After taxes were taken out to live on, he had to give her MORE money.

That’s what I’ve heard from a lot of fathers. Gets to where dad lives in like a 1 bedroom, rents a room, lives in his car or is homeless and mom takes him to court over it and then they say the kids can’t go see dad cause of the conditions. Then dad tries to get a second job to get out of the situation, ex finds out and she goes back to court cause she is “entitled” to that money as well for CS and the judge awards her a portion from the second job as well.

Yep. My friend had to pay $3,600/month in PA for 2 kids! I was like WTFH! It left him with about $1400/month for everything after taxes got taken out. He was like, “Dude, what am I going to do with $1,400/month when my car is $500 with insurance, rent is $650 WITHOUT ANY utilities, that’s also JOT including any food for me OR gas in the car!”

I know but hear me out on this one… Using male logic right… You allow me to write off a percentage of daycare expense where I pay someone else to take care of my kid for time. So in essence, child support should be a tax write-off since I’m paying my exwife to take care of my kid and it should be considered taxable income for her. And same for like a lawyer… I’m paying a service for you to represent me and if they have to be claiming it as their salary and pay tax on it, why you I be taxed on it…

Dude, roll out. You have evidence, look for a good lawyer and talk to as many as you can before deciding on one. See what the law is for adultery in your state is and get out. It’s not worth it. She checked out and moved on while just keeping you there for a security blanket. I would tell AP2s wife as well tbh.
