don't know about Canada but if he had been doing it since day one you can't argue he is trying to hide assets so a judge wouldn't punish someone for doing it since it also raises questions about the spouse not having a proper economical conversation before getting married. however spending money you gave to your mom like it is your own would still net you in a seat where it would be part of the divorce.
