That usually happens when someone consents to be listed as the father on the birth certificate or make an admission in open court that he is the father. There is a procedure to be relieved of a child support obligation if a DNA test later shows that you are NOT the father. But that relief is only prospective - it does not relieve you of the support obligations that have already accrued. That usually where I have seen the horror stories. The "father," under a child support order, falls thousands …

The age of consent in PA is 16. It's the teacher/student thing that makes it illegal.

I agree with all the substantive points everyone is making here about this poor train wreck. . . but . . . Her writeup has a poetic rhythm to it that makes it pleasant to read - the last like ends on a downbeat that reminds me of the structure of a haiku. She needs to drop the "And" in the second line - then each line would have 6 syllables - a nice symmetry and a nice rhythm.

I definitely get where you're coming from. The situation that you describe (each starting off with nothing, husband builds up business/becomes successful) is definitely the most common. Interestingly enough, I've seen a LOT of situations where the wife actually helps the husband become successful (usually by working while husband finishes med/law school). In SOME states, that degree is considered property, and the present value of that degree is a marital asset and the husband is fucked. In Virg…

You don't want your pre-nup invalidated? Then go to a lawyer and have it done right. I've been practicing law for 25 years. I've written probably 100 prenups. Maybe 3 have gone to litigation. All 3 were upheld. I was just involved in a case (I did not write this prenup, but litigated about it). H and W had a HUGE disparity in income and assets - the prenup forbade W from accepting a power-of-attorney appointment from H, provided that H could waive that requirement by specifically referencing and…

There is a very simple solution to this problem, particularly for a guy as well off as this man was. It's called "a prenup." Don't want this former party girl to divorce rape you? Get a prenup. A prenup can be as specific as you like - down to keeping assets separate, keeping the growth of separate assets separate as opposed to marital property, determining how much money hubby will give her as an allowance, a complete and total mutual irrevocable waiver of spousal support - you can literally cr…

Re: your flair . . . hate to be a nerd . . . but constant repetition of consonant sounds is alliteration. Constant repetition of a vowel sound is called assonance. Think: "The rain in Spain stays mainly in the plain." Since your flair repeats a soft "a" (or perhaps a schwa sound), then it should be referencing "assonance" and not "alliteration."

even e.e. cummings knew how to use grammar; though his capitalization skills left a little to be desired.

Respectfully disagree, my good man. At 2:38 the back of her head hits concrete - not enough to permanently disable her - but I think she was out for that brief period.

In some states (Virginia, where I practice, is one of them) adultery is a bar to permanent spousal support and is a factor to consider in property division. He needs to separate immediately (so he is not seen as condoning the adultery) and get a lawyer yesterday.

Don't know about NY, but in Virginia adultery is a bar to spousal support. Let the adultery happen. It will be better for you at trial.

She was 24. They were 17 and 16. FFS. Shouldn't even be illegal.

Many, many misconceptions on this page. I practice family law in Virginia, so my comments will be state-specific - so check your own state laws for specifics. First misconception. "No-fault" means that the offending spouse takes half the property and gets support. Not true. "No fault" means that you can get THE DIVORCE without having to prove fault - you have to prove simply a period of separation. Fault (cruelty, desertion, adultery) does not come into play in getting the marriage terminated. B…
