that's stupid. even if you have to walk, there are laws about where you can walk. having a car break down doesn't give somebody the privilege to walk on the actual road without a crosswalk

I'm not saying it was an awesome situation, or that humans have perfected the concept of justice. this just isn't a pussy-pass. i'm sorry, it sounds cold, but i am glad the courts are objective enough to factor in things like jaywalking in these cases. i would want the same objectivity if i was on trial.

and most highways don't allow pedestrian traffic, that i know of. it is reasonable to assume that if i were going to walk in a high-speed roadway in the dark, i stand a decent chance of getting hit.
