Criminal court is beyond reasonable doubt. Civil court is preponderance if evidence, that is, more likely than not. 51%. That's it. It's the much lower threshold that convicted oj of civil wrongful death after his criminal case couldn't prove beyond reasonable doubt.

Even if you are fired, laid off, downsized due to economy... it goes off your "earning potential" not necessarily current wages. Fortunately this should work on both directions. If she's a teacher that quit to be a stay at home mom..you should be able to have support calculated taking her potential teacher salary into account. Should.
