Just asked my AP government teacher. He says that it's perfectly legal. The 14th amendment is only applied to governmental agencies. So if I wanted to own a business, I could charge extra for any reason I wanted. As long as its not already imposed in a state law. The way the made it so the 14th amendment was enforced was by the commerce clause (any building set on government land can be enforced by law). And the civil rights act of 1964.
