Humans only got married for economic reasons, not love. That's not correct. Why do we feel sexual attraction and love? Because from a purely evolutionary perspective, these things urge us to go in the right direction. Why does sex feel good? Because it makes us breed. Marriage was just the way that makes attraction between couples socially acceptable. If a guy knocked up a girl, there would be the stereotypical father with a shotgun that would urge him to marry his daugher to not sully her honor…

Not every divorce is valid. You think just suddenly over the course of just a few decades women and men are incapable of staying together and marriages changed? Or do you think throughout all of human history most marriages were unhappy and just miserable for both spouses? What is it? I am by no means an expert on England and common law countries, but to my knowledge there is something like a "common law marriage", even if the term itself isn't legally recognized. Something like a mechanism that automatically regards a couple that cohabit together as married exists in common law countries. But the thing is that most disputes arise when these couples divorce anyway.

What would you say to couples married in the 50s, 60s or 70s that had a prenup, before the goverment insituted no fault divorce or other stuff like that? The goverment basically changed all of the private contracts between individuals before. They can do it again. That's why I am sceptical about prenups. And it's not like you can just write into a prenup "Our marriage will work according to the legal rules of 19th century Prussian Civil Law" and then copypaste the law.

You are completly right. But here is the big but. You are probably from the US, which is a country with a common law legal system. I am very sorry to say this, but you guys ... are fucked. In civil law countries there is no such thing as in common law countries, where they recongize prolonged cohabitation and stuff you mentioned as a "practical marriage". Nah man. Church Weddings aren't legally recongized. They are fine. It doesn't carry any legal consequences with it. In Germany they even recently abolished a law that was insitituted, while they were fighting political Catholicism, that makes it legal to do that now. Before it was technically illegal to have a church marriage without having a civil marriage, because many Catholics just ignored the civil marriage the state was offering.
