She really doesn't have any, she just claims it would be better and more stable. He is 2 and I had been his primary care provider since he was born. She resented me being a stay at home dad because I spent more time with our son. The truth is she found out she wouldn't be getting child support and when I got my self together so quickly after being thrown out of our home on the streets and told her she wasn't welcome in my new home after she tried the same crap she would pull when we lived togeth…

The judge set up our custody arrangement to start a month after the hearing to allow me time to get a car as I was kicked out of our home with nothing. She had been picking him up Tuesday nights so she didn't have to do it Wednesday mornings to take him to daycare, she also didn't want me to take him to daycare because I didn't help her pay for it. On the day's I had custody I cared for him during the day. I told her we can meet at Walmart for pickups and drop offs. I had been a stay at home dad…

Yeah right. Your story is off. You did not have a court order saying you didn't have to pay child support then we're ordered to pay back child support lol..just stop.

Lol where is her court order saying she doesn't owe me money??
/r/MensRights18/01/18 03:12 AM

That is fucking retarded. She can't get back child support that was never ordered LoL. Our custody arrangement has already been finalized by the courts. She went to file for child support already and canceled it because I have 50% custody and she makes more money then me so she wasn't getting anything and would most likely owe me.

The family courts are a joke. At the hearing for her protection order against me I played the female judge a video I recorded of her going apeshit on me right before she went to get the protection order against me. Everything she said i did to get the PO is what SHE actually did and the judge said I was provoking her by secretly recording her. Gave her a permenant PO that prevented me from going back home that ended the date of our custody hearing about 30 days later.

Thanks, that means a lot believe it or not.

Our custody arrangement is legal and signed by the judge. She tried to get child support from me but canceled when she either found out she she will owe me or I wouldn't owe her anything. I have been fighting for my son and I all long, she has showed her true colors for a while. I have sacrificed a lot to do what's best for our son and will continue to do so. I'll do what I have to to make sure he is taken care of the best he can be on my days and hers and when the time comes to make sure our be…

We we're never married so she doesn't get alimony or hold support. She went to file for child support but canceled when they probably told her with she would get nothing or that she owed me.

"failure to understand or accept the boundaries of your shared care arrangement" what are you talking about. I'm not trying to do shit but protect my son from someone who obviously is fucking mental. When all that shit happened we were living together. So what you says makes no sense. I don't need a fucking therapist, and I'm not failing to understand my boundaries. LoL luck my ass. It ain't a murder trial it's a custody case, all you have to prove is your kid being around you is in their best interest and in many cases a lawyer is not needed to do that. To be a dramatic bitch.
/r/MensRights03/09/17 06:56 PM

You think a mother and child should be separated because she is a bitch to her baby's dad? If I thought my son was in danger I would do something about it. Bitches be crazy

We're did I automatically jump to the conclusion that because it worked for me it will work for other father's? What " tides acting in my favor" did I not influence by my actions? You make it sound like I lucked into 50/50 custody.

What foolish advice did I give? Who the fuck said record evidence illegally and present it as evidence? This is exactly what I'm talking about lol. You don't need to pay a lawyer to tell you that... Google that shit! I mentioned not being a complete moron in the title.

In VA when you appeal k JDC custody decision you appeal to the Circuit Court and the case is reheard "de Novo" which means they rehear the entire case again and make their own decision that replaces the JDR's decision. You can appeal that decision to the court of appeals but it won't be heard de Novo so you can't present any new evidence and they will only be looking for mistakes by the lower courts. My point is not to say "don't get a lawyer" it is to say you don't necessarily need one. My shit…

Well I don't know what state you live in but n my state everyone gets to appeal. Either way keep telling everyone they need a lawyer like they are some wizards with custody magic tricks, I'm glad I didn't listen to people like you.
/r/MensRights03/09/17 03:18 PM

Okay bud. Tell everyone just like I was told they must have a lawyer as that is your prerogative. The fact is they will do what most men can do them selves if they put the in the time and effort. If they lose they can always appeal and go the lawyer route.

No. She filed for child support before the custody hearing then decided she was going to cancel it because she didn't want to go through the hassle. I had agreed to pay half our sons daycare and heathcare expenses from the beginning but after the hearing she asked me to pay half but didn't like my attitude when I told her I would talk to her about it when I got off work so she threatened to continue with the child support process, I laughed and said that would probably be best as it's the last t…

She currently is paying his daycare and health insurance that is why I would have to pay her. If we split those costs and I payed half she would have to pay me child support.

You are assuming I'm not taking the high road already. You think you were the only one who had to deal with bullshit parents growing up? Why do you think my son's guardian ad litem convinced my sons mother to give me 50/50 custody, why do you think I fought so hard to get it. It's he nature of the Internet, everyone wants to assume the worst about a person.

You are an idiot. I never said or implied she was obligated to bring him to my house I actually said the exact opposite. The point was she is pissed about child support and her not bringing him to my house is what she is doing to get back at me. You made up me thinking she was obligated to do so in your head.
/r/MensRights02/09/17 04:08 PM

/r/MensRights02/09/17 04:02 PM

I was just stating the facts I didn't insinuate anything. We agreed she bring him to my house now she won't those are he facts. At no point did I say she was in some sort of violation of a court order, in fact if I read my other replies I specifically say she isn't in any violation.
/r/MensRights02/09/17 03:52 PM
1

I have already stated the 50/50 custody arrangement doesn't start for a month. Who said she is required to help me?
/r/MensRights02/09/17 03:35 PM
6

I stated a fact of the situation, I wasn't complaining. I get it though this is probably where you come to get out the anger you have for life kicking your ass. I'm winning right now. I was homeless less than a month ago with no where to go. I also had a restraining order from my son's mom against me and without spending a dime on a lawyer won EXACTLY what I wanted in custody. So yeah...I have nothing to get over.
/r/MensRights02/09/17 02:28 PM
4

Again...who said shee was and who is complaining she isnt? My question was about child support. You sound bitter, did you come here just to talk shit lol? Me and my son won so there is nothing to get over.
/r/MensRights02/09/17 02:00 PM

At the moment she is paying for his daycare and health insurance. If we were to split those costs I'm half she would have to pay me child support.
/r/MensRights02/09/17 01:56 PM

Who said she was obligated to play taxi for me? Lol Get over it? Dude I fucking won every thing I had been fighting for I'm happy as shit so there is nothing to get over. She can play this game for another week.

Nothing specific about transfers in the order at all. The judge wasn't very specific at all. This is just her last ditch effort to try to hurt me. She knows I'll have a car soon and there is nothing she she can do to hurt me.
/r/MensRights02/09/17 03:24 AM

Sole custody would be nice. I'm lucky to have gotten 50/50 though I was homeless like a week before our hearing.
/r/MensRights02/09/17 03:16 AM
2

She really isn't in contempt she is just refusing to bring him to my home. If I had a car Im sure I could go get him but she wasn't ordered to bring him over were are just supposed to work it out amongst each other until the 50/50 schedule takes place in a month
/r/MensRights02/09/17 03:13 AM

Of course it was a final custody order.

It's going to destroy me and my son's mom relationship again but I have to protect my son. My son is my first priority and what ever this man's intentions are they are not bin my son's best interest. You don't threaten a parent with violence for them voicing a concern about you to the other parent. You don't tell a parent there nothing they can do to Stop you from being in their sons life, that is beyond crazy.

I tried to keep my son on the restraining order but the judge said it was out of his jurisdiction because my son's mother was taking our son over their and didn't object to our son being in contact with him. I talked to lawyers and they told me i was good to go with the video evidence. The judge blamed me for secretly recording her which is provoking in her opinion.
/r/MensRights25/07/17 11:38 PM
12

I'm honestly at a loss for words for what happened. I had talked to a lawyer and explained everything that happened and he told me the video evidence was golden. The judge looked at it like my sons mom was not responsible for her own actions and upheld the protection order because she can't control her self. I cant imagine a world where a stay at home mom would be thrown out on the street because a judge claims she provokes abuse from her sons father.

I'm not going to take my son away from his mother, she is not abuse towards him. If I ever feel like that were possibility I will take the necessary steps to protect him. Just because she got so upset she said she wanted to punch me in the face doesnt mean she should have her parental rights taken from her.
