No. Separate property is not included the valuation of the marital estate and judges cannot “award” someone your separate property. That’s not how property rights work.

Well, if I was across the table from you, I’d at least make a play for the 403b contributions depending on how much $$s lol. But I also wouldn’t expect to get it :) I actually think you may get a deal in mediation depending on, among other things, who the mediator is.

I’m pretty sure you’re in king county - you must do adr before trial, that’s just how it works. Honestly, I think you’re sol requesting to value an asset with fluctuating dollar value as being worth what it was when you filled. In my case, we essentially did the flat dollar credit/value calculation on the day of mediation using my ex’s updated financial disclosures and then converted that to a percentage of the account which was stipulated in the cr2a.

If you’re in Washington in most counties, you are required to do alternative dispute resolution, which is usually mediation, before trial.

Honestly - in high net worth divorce, alimony is a pretty silly instrument for wealth transfer. where you’ll probably end up doing most of the wrangling is the valuation of the marital estate. It’ll be about horse trading specific assets. You can both afford good representation, and while your wife might be a workaholic, she doesn’t sound crazy so it’ll probably not be that awful.
