I think I would counter by saying that perhaps it makes sense to give the accused the option of being able to sue the accuser afterwards in a separate trial that occurs after the accused has been released. I think it makes sense that the accused should have a civil cause of action with criminal penalties (similar to RICO cases), though the standard should be fairly high. I mean if you accuse someone of a crime that they are later exonerated from; you've got a pretty obvious paper trail of a false accusation...
