I completely understand how it would be heartbreaking for them but the child is not theirs and they know it. He cant be convicted of kidnapping or custodial interference if its his baby, its like putting someone in jail for taking something that belongs to him, on the other hand if its not his kid he'd be convicted of kidnapping or at least custodial interference. In the US a woman can not give up a child for adoption without the father's consent, she can say that she has no idea who or where the father is. If you find out that your child or a child that's probably yours has been given up for adoption you can get a court order to find out where the child was placed and for a paternity test.
