I didn't see any indication of your jurisdiction, so take this with a grain of salt. Also, IANAL, and I hope you have engaged an excellent one who will go to the mat for you and your baby girl. The odds of you getting joint custody (or joint guardianship, the new language we use up here in Canada) are excellent. The family bar here is well informed that children have the best outcomes when they have regular access to both parents. Courts like 50/50, apart from extenuating circumstances dictating…

In Canada, judges are awarding women amounts that are more than a guy's pre-tax income [...] I haven't heard anything about this. Can you direct me to a publicized example? If this is real it needs to stop.

$1500/month for child support is outrageous That's average for where I am. For two kids though.

Until a court order says otherwise, you're just as entitled to see/parent your children as your STBX. She can't withhold them from you without damned good reason (you're a drug addict, alcoholic, history of violence, etc) and if she tries to, document it thoroughly. Judges get exceedingly pissed off at parents who try to restrict access to the children. Also: Document, document, document. Save text messages, emails, anything and everything. If you speak to her, note the details, although if you …

I know the painful truth, I'm going to lose my kids to her and I'm going to pay essentially my entire paycheck to her. First things first mate. You are NOT going to lose the kids to her and your paycheque is NOT going to end up entirely in her hands. You MUST, and I can't stress this enough, MUST consult with a family lawyer, and do it ASAP. They often give you the first consult free, to see if they can help you. Don't settle for the first one you see. Go talk to at least three. Then pick one. C…

it's so you can protect yourself and try to limit divorce madness. I echo this a thousand times. I didn't do this and had to fight extremely hard to avoid being completely shredded. It's a year+ after the settlement and I'm still fighting. Protect your baby. Protect yourself. Be prepared to treat your STBX as an enemy.

I can't speak to your jurisdiction, but in Canada I've never heard that one spouse would have to foot the legal bill for another in a divorce. People have been known to go into debt to pay for their litigation. I would clarify this with your own lawyer in Kentucky. Don't forget that many lawyers offer a free initial consult to help lay out your options for you. Definitely shop around, don't just go with the first lawyer you meet.

She has told me not to take her to court because she will take more than $900 a month and all of the kids. Which I don’t think this is true. The only person you should be taking advice from on legal outcomes is your own lawyer. She (and her lawyer if she has one) can and will say anything to obtain an advantage. I learned that the hard way. Your Y chromosome doesn't make you any less a parent to your kids. This "visitation on weekends" offer of hers is pure BS. Do try to keep it amicable, but ap…
