In Nevada, child support is capped at $850 and has a clear formula for the calculation so there is no discretion by the judge. This also means that any mother who earns more than the father in a divorce will be obligated to pay child support if the father has joint custody or greater. Although it is a little strange that even in cases of joint custody with equal time, one spouse may have to pay the other if they earn more.

At first his attorney responded that they would not abide by that order because it was an undue hardship to force somebody to withdraw retirement funds and face penalties. The deadline for making the payment to her passed and he received an order to appear for being in contempt. He showed up and the judge said "pay now or go to jail".

pcarvious is correct... she had already hired an expensive lawyer and submitted that her costs had reached over $50k. My friend had never considered dipping into his 401k* so he had only hired a cheap lawyer for himself from what he could afford. So in the end her attorney was 5x more expensive and he had to pay for it. The judge didn't care about the disparity. Fortunately he won joint custody anyway. *My top-level comment below explains that he was ordered to liquidate his 401k to pay for her …

In my friend's case it was because the divorce included a custody battle and both sides having adequate representation was considered "in the best interest of the child".

My friend was ordered by the court to liquidate his 401k to pay for his wife's lawyer. This was for an 11 month marriage and he built up the 401k for 10 years prior to the marriage so it was clearly separate property. Also, he was solely on the hook for the 10% early withdrawal penalty and income tax owed on the withdrawal.
