Age of Consent is generally used for the age one can have sex legally afaik. In Germany there are two terms (Schutzalter for Age of Consent and Strafmündigkeit for the age when a person can be held legally accountable for their actions), both being 14 years of age. For example if 2 13 year olds have sex, both break the law, but because they both are younger than 14 they can not be charged. But if one is 14, that person can be.

Unfortunately i KNOW that a lot of mothers do not care. Also, the mother can do pretty much nothing against it once the age of 16 has been reached by the child in that regard (still speaking of the situation in Germany). And again, i am quoting the state of affairs. Please do NOT assume that i think this is a good state of affairs or that 'I' would act on or condone such actions. Seriously, read what you quoted: It can be if a court decides - that right there is the important part. A parent or guardian needs to complain about it and than a court needs to decide that there are circumstances that prove that the younger partner was taken advantage of and did not have a state of mental development that indicates that they could consent to the relationship. So the age itself is NOT enough. There have to be circumstances others than said age.

I live in Germany. I also had this argument multiple times. There are some stipulations to it and to be completely in the clear both partners should be 16. But there already have been court cases that explicitly stated that just because one partner was 14 or 15 and the other older, even significantly, that this alone is no argument for it being illegal.

Uhm... Sorry, but: this highly depends on were it happened. Age of Consent in Germany for example is 14, so nothing illegal happened according to German law and most European countries have lower age limits in that regard. If the lower aged partner was not forced or tricked into the relationship, nothing wrong with it. That is the law part. Now moral is a whole other thing.
