Abortion is a bad comparison, and isn't necessary for the sake of the argument. A better analogy is women's ability to unilaterally reject parental responsibility, including financial responsibility, by placing the baby up for adoption within some time after the birth. I don't know about domestic violence, but I'm pretty sure that in sexual assault and rape cases, American judges will explicitly instruct juries that beyond a reasonable doubt doesn't require material evidence, doesn't require DNA evidence, and doesn't require a witness.
