will just show others you are not trustworthy This is Family Court, remember. I'm being cheeky. I get your point. But there's a 100% chance that his wife will lie under oath and the judge won't care. It's Family Court; it's not like it's REAL court. Everyone is expected to lie.

This sounds like tedious work You've asked plenty of questions recently about discovery. I hope you've seen my replies about objecting to discovery questions. Overly-burdensome is definitely one objection. Five years seems like a long time. Also, take this for what it's worth, but here's a dirty lawyer trick I learned: When you answer discovery, do it with physical paper print-outs. When I answered discovery, I was trying to be polite and professional and gave them PDFs, which can be easily sear…

Just curious, is your kid a dual US/Canadian citizen? If so, on top of everything else you're doing, I'd get her two passports now. And, if possible, hold on to them as you're going through the separation. You never know when having them in your possession could come in handy. If your STBXW ends up with them, you can be sure she'll weaponize them.

Know the names of your children's teachers, doctors and friends. Know some specifics. Quick story about me: I was very involved in my daughter's life when she was young. I absolutely knew her teachers and doctors; I often drove her to school and walked her to class; I took her to her first dentist appointments; I knew where her friends lived so I could pick and drop-off. I knew the parents of her friends. Ask me anything. But I had to work overseas for a while (long story) and during that time, …

Let your STBXW know that every dollar you guys give to attorneys ... Two answers. One, if OP's wife is like my ex-wife, it's not about the money. It's about a deep, pathological need to win at any cost. It's an unreasonable motivation that you can't bargain with. Think: A woman who spends $1000 on lawyer's fees to get $500 ahead. Or the woman who fights to get custody of their dog, then puts it to sleep. Lawyers love this kind of litigant because they're never happy and it's all billable. Second…

I think you've posted more than one question about discovery. I hope you saw my reply about objecting to certain questions. HERE are some good examples. I am not a lawyer, so take this for what it's worth (which ain't much!). These are just my initial gut reactions. 1: Is this a no-fault divorce? If so, all of this is irrelevant. That's the whole point of a no-fault divorce: no one is at fault. But if you're alleging that misconduct on her part entitles you to something, then, yes, I suppose you…

an expectation of failure Let's recall Bill Burr's stand-up routine on the probability of having a successful marriage. "If you wanted to go skydiving and learned that only 50% of parachutes open correctly, would you still do it?"

A woman that won’t take your name in a marriage will gladly take your house in a divorce That's a great line. And I love the word-play. What's especially funny is what happens when the subject of name changing comes up. What happens is that every woman suddenly has a Ph.D. On Feminist forums, including here on Reddit, when the subject comes up of a woman changing her last name upon marriage, there's usually a big backlash. And, amazingly, a big reason is that, apparently, lots and lots of women …

Over the years, I've bookmarked post-divorce articles that really resonated with me. Obviously, if you're writing a new piece, you can't just copy-and-paste. But maybe some of these will give you some insight and some ideas. My Doomed Mission To Make Her Happy The Divorce from Hell Virginia needs to reform alimony rules shocking line: Virginia awards permanent alimony to young healthy college-educated working age spouses in established careers who were married for less than 10 years, whether the…

now I am rushed I'm not following. Why are you in a rush? Normally, you have 21 days or 28 days or whatever. Did your lawyer not give you timely notice? Be advised that the opposing lawyer will ask for ANYTHING and EVERYTHING. In many cases, they're on a fishing expedition. Aside from the possibility of discovering something juicy, it also runs-up your legal bill. Here's the good news. You do have some protections. In many states, there is a limit to how many questions they can ask. Google it fo…

The tolerance for perjury in family court is absurd. I was very tempted once (but chickened-out) to say at one of my hearings: "Your Honor, I'm a nine-foot tall Chinese women named Barack Obama. With my right hand raised, I SWEAR TO GOD THIS IS TRUE." I was deeply frustrated. I caught my ex-wife in one lie after another. It was comical after a while. To me, if the court does nothing about perjury, then what's the point? The court has no integrity after all. All the black robes and fancy legal La…

Here is one idea, and it's just an idea. Her infidelity probably won't matter much in the divorce. But if you can get your wife to lie under oath, you can milk that cow all day long ("Judge, she lied to you; she has a reputation for not telling the truth. How can anything she says be trusted?"). Figure out a way to have her testify in court, or answer discovery questions, something that she needs to answer and you know she will lie. Normally, you need to declare whatever evidence you have in adv…

she said that she does not have a crystal ball Wow, does this sound familiar. First, sorry brother that you're going through this. My lawyer also never gave me a "warm-and-fuzzy" feeling that things were under control. One day, the opposing side did something very unexpected and perplexing (long story, but anytime you're in battle and the other side immediately changes tactics, you know SOMETHING is up). When I asked my (female) lawyer why they did it, her reply was a shrieking, "I don't know! I…

he needs to make every last effort to make those payments Where do you draw the line? Or do you draw one at all? Should he cheat the IRS in order to pay alimony? Should he take cash advances from his credit card? Should he borrow from his pensioner mother while knowing that he can't pay it back? Your sentiment is another one of those useless superlatives that's often found on this subreddit. Just like the advice to ALWAYS have a lawyer, always, always, always... even if you're broke? Even if you…

Two issues. Why did your lawyer wait so long to give you the questions? Sounds like your lawyer dropped the ball there. Next issue: the interrogatories (as you say, "extensive and requires time"). Be advised that the opposing lawyer will ask for ANYTHING and EVERYTHING. In many cases, they're on a fishing expedition. Aside from the possibility of discovering something juicy, it also runs-up your legal bill. Here's the good news. You do have some protections. In many states, there is a limit to h…

BION, I have some experience with this. Before I share, some technical advice. When you pick the registrar (to register the domain name) and pick the host (to host the files on their server), use overseas companies. Often, these services are offered together by the same internet services company. Avoid GoDaddy and Amazon. Find a company in Russia or Panama, far from US jurisdiction, who will ignore any US court order. Also, for another layer of protection, I used fake names and throwaway e-mail …

I thin that's exactly what he's doing here. But after 30 years, there's really no way around alimony.

Bullshit. I divorced 4 years ago and have an amazing relationship with my kids. Congratulations. But now you're espousing statistics with a sample size of one. Sometimes bystanders 'take sides' in a divorce. Plenty of men have lost meaningful contact with their kids after a divorce. It's a real concern. I'm your age and living my best life after divorce. The same. That's good for you. But again, plenty of men find themselves returning to court, years later, dealing with an ex still bickering ove…

Normally, I mailed checks to my ex-wife. But we just happened to have another court appearance once when a payment was due. So I decided to just give her cash at the courthouse (YES, before you ask, I did get a signed receipt!). Anyway, earlier that day, I had taken my daughter out for a meal. I think she was about 12 at the time. When I paid, I opened my wallet and she saw a fat wad of 100 USD notes. Her eyes suddenly popped-out of her head. She was shocked that I had so much cash. To her, it l…

My STBX screwed around in college ... is horrible with money. I was valedictorian in college, busted my ass, saved money ... I went through a long, bitter divorce that ticked every checkbox (BTW, to answer OP, $6625/month for the first year, then $4800/month after). I had plenty of reasons to be sad and upset. I lost everything including the kids. But one day, my elderly mother inadvertently punched me in the gut harder than any ex-wife or judge. She really didn't mean to make me sad. But she po…

Her lawyer ... will take any available shots ... below the belt The lawyer can always argue he's merely representing his client with zeal, which, actually, he's ethically obligated to do. Some lawyers are just cunts.

like how we communicate and the tone used Unless it gets threatening, I doubt most judges would care. In many ways, such orders are unenforceable. I'd document it if it's in writing. But filing a motion with the court sounds like a waste of time. Another aspect (which may be way beyond the scope of your question) is there is some question over the Constitutionality of these orders. I am not alone in thinking that Family Courts routinely overstep their authority by issuing orders that limit free …

I'm talking about Temporary Orders for support and alimony The phrase you're looking for is Pendente Lite which is basically Latin for "pending the outcome (of the trial)". And you're absolutely correct. If the temporary financial support orders are too high, you might be tempted to think you'll get another bite of the apple later on and get them lowered. After all, these are temporary orders. But, in many cases, the Pendente Lite orders quickly become normalized. If your divorce drags on for 18…

I appreciate the Marine's input. However, I would point out that there are major cultural differences between the branches. An Air Force officer will have a very different experience than an enlisted Marine. I'm reminded. Many years ago, a young man aspired to be a military pilot. He had appointments to both the USAF Academy and the Naval Academy. He couldn't decide if he wanted to be a Marine officer or an Air Force officer. He asked the internet. This was the viral reply: (emphasis mine): USAF…

Language? Ha, I just noticed your username. Hey man, if you're 30 and can still learn new languages, go for it. The best time to learn a new language is when you're young, teenager or younger. I'm in my 50s now and my brain is mush. I learned some Spanish and French as a young man. I just went on vacation to Portugal and didn't even bother trying to learn any beforehand; I knew it would go in one ear and out the other. As long as I can ask for beer and a bathroom, I'm good anywhere in the world.…

Two bits of advice. Try to find a crusty old USAF First Sergeant (or, really, a First Sergeant from any branch). A First Sergeant in the Air Force can be E-7, E-8 or E-9. But the point is, a First Sergeant's priority is to take care of his men. Senior NCO peers, such as a Senior Chief Petty Officer or a Command Chief Master Sergeant, is going to be more focused on command issues and kissing a general's ass, not the welfare of low-level airmen. A good First Sergeant really looks out for his men. …

I just need to figure out how to make the payments without her finding out You can still buy Money Orders at any Post Office. It's an Old School payment method, but still works great in this digital age. You can buy them with cash and you don't have to show ID. With no ID, it's very difficult to reconstruct a paper trail. There's as good as a cashier's check (at least to most people). If you have a trusted friend (really trusted), you could slip him some cash, and have him pay your bills. It's E…
