1	Pension/401k is it calculated post or before tax? Qualified Domestic Relations Order (QDRO) is the legal process I believe. You will basically fill out a form with whatever she is supposed to get and submit it to whomever holds your 401k for you. They will likely create an account in her name and deposit the funds as her own 401k/IRA. Then she can either elect to keep them with that provider or move them to a firm of her choosing.
