Lost a good job because always had to go to court to fight her nonsense motions and it didn't stop for 12 years. (Luckily, I eventually found an understanding employer.) Ex always fought for full custody, make-up parenting time, ending/limiting sports on my time, ... and now that son's in college she has little time for him when he's in town. She never has and still doesn't let him stay at her house alone so he's with me almost exclusively now so that's a big W. 😆

*pfft First attorney, local men's only chain, was $15k non-refundable retainer plus $10k in maintenance account to be auto replenished when billables drained that below $5k. All this was 15 years ago. Can't even imagine now.

From personal experience, judge will probably treat any refund or liability as marital property and divide it 50/50. If you or your lawyers had accepted that possibility, you could have tried to maximize your return(s).

This was about 15 years ago and they had the video technology to handle this back then. People get arraigned and testify remotely (i.e., from jail) all the time. This just needlessly prolongs the process and wastes everybody's time, and not just the people in this case.

Then the judge realizes mom's going back to prison for the second DV conviction, but yeah.

Was in court one day waiting for my divorce case to be called and watched this one case in action. The father had filed a motion for sole legal/sole physical custody of the kids because the wife had recently RE-DV'ed him! He was there with his lawyer, mom's lawyer was there and judge asked where mom was. Her lawyer said she was back in prison for re-DVing the father and violating terms of parole on the first DV conviction. Judge asked when mom would be out of prison and her lawyer told her 6 mon…

You should be able to use her past/current psychological and substance abuse issues to your advantage with regard to custody and/or parenting time. Consult a lawyer asap.

Yes. Oh, sorry. I didnt realize you didn't want to see your kids any more. Congrats on only having to spend $24k for the swift resolution of your divorce case.

I "don't understand the reality"? What the hell does that even mean? I told you the reality. The reality in our state is that parents with joint physical and legal custody of their children are forbidden to move more than 100 miles or to another state, even if less than 100 miles, unless allowed by a judge. Thus, there's no need to bargain that with a soon-to-be-ex spouse. Not that it applied to or was ever going to be an issue in my divorce, I initially heard about the 100-mile rule through a c…

Ah. Based on what we went through, there's no way that would get accomplished in a six-month time frame when kids are involved. Time aside, State law prohibits a move of more than 100 miles or to another state even if less than 100 miles, unless a judge has approved it. People have done it unilaterally and have been ordered to move back. Also in our state there's a six-month cooling off period where nothing can be finalized, again with kids, regardless of how amicable, thus my comment.

Only $24k all said and done? Sounds like it was fairly amicable. First lawyer interviewed wanted a non-refundable $15k retainer. ... Guess it depends on when in your life you get divorced and both parties' financial situation. If there's a disparity in income and or personal finances someone's gonna come out of it with less and someone's going to gain. Our divorce, bottomlined: XW got about $70k in cash for difference in retirement accounts and house buy-out, while I got a paid-off house and a c…

Our state sucks with the CS calculation. It SEVERELY favors the party who tends to get more overnights (i.e., the mom) and because she had a few more overnights she collects despite making more money. I went to many others states' CS calculation websites and I would have collected CS except for the few states in the country that use the sum of days squared algorithm. As the name suggests, it is a non-linear model and as a result severely penalizes the party with fewer overnights. IIRC, I played …

He probably made more than her if they had 50/50 and he was paying CS. Ex made almost twice what I made and we had near 50/50 and I had to pay $100 per month. Arbitrator ruled no alimony for either of us because we had jobs and likely always would.

IMO, stay away from the Men-only law firms. They'll hit you for a huge retainer and they offer nothing that any other lawyer can offer you. They don't know any special laws, tricks, ... Depending on the complexity of your case, you could do it yourself. Otherwise, talk to friends or co-workers. Possibly asking your parents if they have any riends who might offer a recommendation. Good luck.

Could have saved $150,000 each in lawyers fees, but ex wanted to fight for everything. She got $100 a month in CS and approx. $70k in cash while I got paid off house and $500k of her pension.

Depends when in life you get divorced and if you're only talking about money and physical things.

No, no depositions. They were interrogatories, lists of questions you give a written response to. Several rounds of them with dozens and dozens of questions. Tooks months to get through.

The poor bastard that had to deal with phone calls and emails from my ex got $5k, $2.5k from each of us. First judge was old and incompetent. Lawyers I knew knew her and none had anything good to say about her. She recessed often, and according to teammates, she was calling other judges about what to do. Feel sorry for those in Criminal court. Second judge was ok. Called out ex several times during hearings. Almost two years of stagnation due to her health. Third judge was a cüñt. Arbitrator den…

Ours was not your typical relationship so I definitely do NOT recommend copying it 🤣, but... I'm not saying it wouldn't have beeen contentious anyway (because of her), but because we lived together before getting married it made determination of monies more complex, so that required an actuary... well, two, because the first one retired and moved to another country a couple years into the divorce process so the second one had to start all over. (I'd forgotten all of that until now... Thanks! 😉) …

Is it your pre-marital house or did two buy it together after you were married? If it's pre-marital then you can't be forced to sell it unless you need money for lawyer, etc. If it's marital and, say, she put 100% of the money down on it, it doesn't matter: you split the proceeds 50:50. Child support depends on number of overnights and each party's income, not what you have in the bank, not what the house sells for, ... It'll be straightforward to calculate chold support if you have jobs that ar…

You can't unless something happens to the judge. Our first judge moved from Family Court to Criminal just under two years into the divorce, so then they assigned a second judge. Second judge went along for a couple years then got cancer so everything hot put put on hold for 9 months! Nothing was reassigned, just stopped! About a year after returning, same (second) judge was in a car accident and out for another 6 months. Came back to court and Bailiff had to wheel her in and out, lift her up, ..…

Sorry to hear the news, brother. Not going to lie: it's going to hurt emotionally for a while, especially since you don't want the marriage to end. Since she's already filed (dunno if you've been served yet?) you're going to want a lawyer, too. Not sure of the magnitude of the differences in respective incomes; however, with three kids and her making more than you you should get child support if you get equal/near-equal parenting time. Heck, if she makes way more than you she might have to pay f…

Sorry to hear that, man. The cops are always too late to witness anything and never do anything anyway. I remember the first time ex violated parenting time and I called the cops. The first thing they asked for was a copy of the divorce papers and documentation of the parenting time schedule, which I didn't have. They write it up, tell me sorry and to call my lawyer, and have papers next time. The next time it happens I have all the papers with me, they look at them, tell me there's nothing they…

I feel for you, man. Obviously it depends on the state, the county, and the judge. Everything is a variable in the overall equation. The $90k salary difference is the largest factor. It depends if youre making $390k and she's making $300k versus you making $120k and her making $30k because with the latter you're going to have probably pay for her lawyer if lawyers are involved. It's great you get to work from home and do what you do for the kids, but is there a reason why the chores are so lopsi…
