I think a lot of it is sexual confidence. If you haven't had sex, or haven't had sex recently, then women notice this and your out of the sexually active group. If it was at work I'd put both colleagues on paid suspension, and then gather evidence quickly. Or if it was at university I've ensure neither student sees each-other. I'd give both the alleged victim and perpetrator anonymity. If it's clear that nothing happened, and in this instance it was, the case wouldn't go to trial. It would be dismissed. If a person is at a party passed out on the couch, and someone has sex with them, then yeah it's rape. If a person has so many drinks that they black out, and then have consentual sex with someone else, they consented at the time, so I can't see how it can be considered rape.
