First, I don't know much about the structural nature of psychopathy... But that seems like Minority Report level stuff. Do we have incontrovertible evidence that they cannot control their psychopathy? If we can't be sure that they cannot fix their ways, then we can't condemn them based on such an assumption. In some ways, 15 months for this might be fine. She was 17, first offender, and didn't physically kill him herself. Yes, mentally tortured and goaded him into killing himself - which is very similar to domestic abuse. If the law was applied equally, both would be charged with assault. The thing that I was wondering is... who is the one charging the other with assault. Is it the state doing the charging or is it the individuals bringing a case to court? If its the individuals or individuals asking the state for bringing the charges, then I guess its in the interest of both parties to not bring any charges. There are laws for such things already in place (not sure about Brazil but I would bet they have them too... this is a pretty common sense law).
