Assuming the waiving was done correctly by the lawyers and included the appropriate anti-lepis / crews clause, it should stand. With that said, anyone can file a lawsuit on anyone for any reason. This is very likely just trying to bluster you into giving her something and, if you stand firm, should blow over.

I would ask her if she still wants mediation or if she wants to lawyer up. It is cheaper to do mediation and she may have just used the lawyer to file for divorce. Lots of people use a mediator and then use their own individual lawyer to review it to make sure that things are okay. My mediator encouraged us to do that.

Question 1: Nope. Michigan is a no fault state and so her conduct is irrelevant. Question 2: Up to a judge. Her infidelity is not a factor but her felony conviction is very likely a factor. Question 3: Yes. No fault state.
