Okay, I have to admit I don't know exactly how your laws in America work and also I don't know about consent laws with alcohol involved in Germany. I'm sorry, but rape doesn't mean that one of the parties is drunk. He literally said himself HE initiated first contact between the two, he even remembers it meaning he was aware of himself.
