I would make sure you know the laws in your state for audio recording. Some states require two party consent for audio recording. Your situation sucks! I would figure out how to separate in your living situation asap.

Personally, I would take the funds in the account out and move them to an account under your name and let that money sit there until the divorce is finalized. Once it is determined how the assets will be divided. If you can use the money to pay any marital debt this would be acceptable. From my knowledge the money in the account if acquired during the marriage is a Marital asset in which both parties are entitled to an equal share. Honestly, how much are we talking about? It takes time to overcome, just like any grieving. I’m not sure of your financial situation with the house, but the market is not buyer friendly right now. If I was to sell and buy the same house next door my mortgage would go from $1,800 to over $3,000 a month. You need to work on making a new life for yourself and dwelling on the past. If you keep dwelling you will never overcome this.

Of course. If an ex wants to make a situation difficult they will and can get away with a-lot of it in my experience. My ex directly defied our custody order and refused to send our child during our agreed time for my custody. I had the police conduct a wellness check of their residence. The police called me back to inform me my child was safe and the ex stated she didn’t send her because it was an inconvenience to her. Used my attorney to take it back to court, no legal actions were taken again…

Best to ask an attorney. From my understanding the house would be considered a marital asset along with any other property if acquired during the marriage. Each party would be entitled to 50% equity in the property. Individual bank accounts would also be considered a marital asset if the income is earned during the marriage.
