Judge Richard Posner made a big deal about this issue recently and stepped down off the bench because of it. That's one reason why it was in the news in the last year.

Men don't petition the court because lawyers are very expensive and courts do not like pro se litigants.

Family courts are funded by the states. They are not federally funded. At least in the United States, this is determined by principles of federalism. Family matters are run by the individual state.

Much of it, I think, is just laziness or, to put another way, a desire to quickly move through the cases. In order to do that, you have to come up with certain presumptions. These presumptions help them decide cases efficient but they are not just because they are not based on the facts of the case. In addition, I think the judges begin to numb out. One father goes through it once. They see 700 if not more a year and just began to ignore the facts and move it along.
