Yeah, I also think it might be worth noting that of all the people caught in this scandal, she had paid the lowest amount in bribes. That said, I still think they should have given her a month. Definitely agree with you there. It's never good for any group to fragment and become insular like that. There is certainly for cause to ban trolls or people who are toxic, but just randomly banning people based on group association is not a good way to build a constructive conversation. On that note, got banned from the Donald a comment on their page telling them that they didn't understand how the Constitution worked. I guess any extreme group on the internet exists similar behavior

Well, I simplified a bit. It's more a test about whether the force used to defend yourself was proportional and reasonable under the circumstances. However, using a weapon for defense (especially a metal bar, which in NY could be considered deadly) tends to mean your defense won't be proportional unless you were under serious attack

well, in New York, the law states that you must defend yourself with proportional force. Further, NY law does not permit you to use a weapon in self-defense when your attacker does not have a weapon or is not threatening you with serious personal injury. That is why he ended up having to defend himself

He did win the lawsuit. The defamation suit was dismissed and the judge ordered sanctions against Daniels (up to and including reasonable attorney's fees). Based on my experience in the federal courts of NY, this fee is a little high but it is definitely in the ballpark of what she can be expected to pay
