We separated in June, and still lived in the same house for half of August and all of September before she escalated her behaviour and I moved out. Our separation agreement was dated for June 20, so that’s the date a divorce can be granted. The Divorce Act is Canada-wide, each province can have slightly different rules. Apart means that you are not together, not living in separate places. Your lawyer should be able to guide you more, I found one that was flat rate, and had an u contested divorce

You can apply for a judgement of divorce a year after you separate, as long as there is a separation agreement. I just went through this and should get the divorce decree in the mail next week. I’m in Sask.

Thanks for your opinion. I am already seeing a therapist about the separation, and it was he who opened my eyes to what was going on. The night in question, she was drunk and I know better than to have a confrontation with drunk people. I was too in shock to do anything else, I couldn’t believe her audacity. She snuck him in at 3, and our dog was losing his mind. I had to grab him and put him in the spare bedroom I was in, and I heard them in the other bedroom. He left at 5, the dog barked again. The kicker is that he parked behind my car and heard me yelling at the dog to stop barking.

Currently trying to have an amicable separation, but she won’t agree to pay half of the separation agreement. She keeps shifting the goalposts, and trying to incite me. Thankfully no kids, she was always going to be child-free.
