Quite the opposite I would argue. Any respectable BDSM community is already much stricter on consent than this. You need to establish clear consent, safe words, soft and hard boundaries before beginning anything.

Thats not what it means at all. Law is still innocent until proven guilty. It just changes the wording of the accusation from he forced me when I said no to he forced me when I didnt say yes.

I've taken pyschology at university. I can tell you that psychology is incredibly important. It was psychology that destroyed "facilitated communication" which was an unethical practice that essentially took all of a disabled persons choices away from their family and to a pseudoscientific facilitated communicator "professional".
