Yes, you need a court order to stop it, but emergency orders can be made and they are 100% enforceable. Whenever I hear people say "they don't enforce my court order?!" who didn't? Your lawyer? You? You can't withhold the kids if there's a custody order. Period. The opposing party can be put in contempt. I've worked in family law for awhile and I've seen great coparents suddenly turn on a dime over some issue and get outright hostile. We have lot of male clients we've won custody and repped lots of women who have husbands who just didn't take this stuff seriously. A few things for OP re: this advice. Before you start recording, you need to know your state rules of recorded evidence. You need to know if you are a two party state or one party state for recording.
